I was talking to an attorney over the phone today and she said that PERM can be filed followed by 140 even if I am outside the country (working for an overseas department of the company) and I can come back on L1 / H1B, because GC is for future employment.
We were discuussing this because I was concerned that I may not be able to file H1 extension if the PERM is not filed 365 days before H1 extension.
This would be totally awesome coz I would love to work in some other country for a while.
Is this really true? (seems too good to be considering that everything else seems stacked up against us). Oh, if it matters to the discussion: I'm in EB2/India/retrogressed ad infinitum.

Nothing to worry dude. Your wife is not out of status. Her I-94 is valid. No issues with 485.
You need to file for her extension for H4 with the new H1b so that she can continue her h4 status after sept.

oi antonio, tudo bem? brasil vs. croatia hoje... muito facil para os brasileiros :)
a couple of comments. i agree with el hacko and jliechty that the front strawberry should be the one in focus. the ones that are in focus are not special and you can't see the entire berry so there is no compelling reason to focus on them. at least the one in the front is whole and big.
you might also want to 'soften' the light and eliminate the hot spots (overexposed) that are on the fruit. there should be more pretty color where you see white. you can use bounce flash or a diffuser to accomplish this and still get the bright look.
adding more attractive texture to the strawberries might be accomplished with some water droplets, especially on the leaves which look kind of dry.
food photography is one of the hardest disciplines but you're doing a great job.

I have an appeal Pending with AAO for a denied I140 EB3 India 2004, If I withdraw my appeal and refile I140 I know I will loose pending I485 application. but will have ability to extend my h1 in november showing the refiled I140?
Recently went through the following info....don't know if it helps you or not....
USCIS Policy on Refiling of I-140 Petition Pending AAO Appeal
The AILA-USCIS Service Center Operations Office Liaison minute indicates that the USCIS will allow the employers to refile I-140 petition when the denial of I-140 has been appealed and pending before the AAO. However, such refiled I-140 petition will be held in abeyance pending the decision of the AAO for the appealed I-140 petition. It advises that in order to seek the adjudication of the refiled I-140 petition, the employer must withdraw the pending AAO appeal. I think it is apparent that people on this forum are frustrated with media representation and lack of understanding of the problems that our group, and those that we represent, face.
Without wishing to get into general political debates, it is probably a fair assumption that American citizens who are actively part of grassroots activism would be concerned about our situation if they knew about it.
There is a voice in numbers, and I believe it might be a good idea to reach out to organizations such as www.indymedia.com (http://www.indymedia.org/en/index.shtml). This is a main hub, there are various regional versions of the organization.
Just another thought on how to publicize our issues.

Your I-485 will not get approved until the dates become current for you. For eg. say in March 2009 bulletin (which is valid from April 1st of 2009), your priority date becomes current. Your I-485 can be approved only after April 1st. Just have your wife's application ready and apply on the first day when your priority date becomes current.

If yes then you should be fine but with or without original 797 and no stamping in passport it will be difficult to get into USA. Unless you have AP to get back into USA. Hope this help. Good luck for your travel tomorrow.

My wife is on a H4 visa. Her visa is going to expire june 2010... she has to go to India later this month on a very urgent work....
So is it advisable to go considering the scrutiny at port of entry nowadays ???

I think it can be. When starting the employment based GC process, one of the question asked was ... has any family member ever applied for your immigration petition in the past. Just an educated guess... check with an attorney

I dont know - but call uscis and ask - also you may take an infopass appointment and find out what to do in such cases
If they say surely it'll be rejected/ returned - just do another application (so that you can make max use of 120 days)

I guess EAD is personal property not employer property. I had filled my I-485, EAD and AP and my employer does not even know it. On top of it i had completed 180 days and moving to another job.
Are you in H1B or EAD. If in EAD you have to renew it yourself the employer has nothing on your EAD.
I am seeing lots of people change their jobs once 180 days expire...Just trying to get an idea whether people mostly use H1 transfer or do they start using EAD? Does changing a job while 485 is in progress always triggers an RFE/interview?
