Hi,
My employer has been playing this game with me. He filed for my Labour and it got approved in August of 2007. However he did not file for my I-140 until Feb of 2008 , just a week before the labour would expire. Now its been over year , he does not give me my SRC number but keeps telling me its been approved under EB-2 catagory. As for me , I am current in EB-2 , I just checked April Bulletin and I still am current. It looks like he is not going to file for my 485. Is there anyway I can make him file or file myself. Please know, the lawyer is on his side as well. I have asked the lawyer number of times for SRC number but he does not provide that either. What are my option other than joining a new company.

Unless it is an expired "conditional status" card, your legal status in the US in no way changes. Only the card expires and not your legal LPR status! I don't quite understand what your "mistake on birthday" comment is all about!
You are still a legal permanent resident and can apply for a job proving your eligibility with your Social Security card and valid drivers license/state ID.
Get a new card by filling out form I-90 with USCIS and pay the required fees.

I am an Indian national currently in the AOS-pending state. My wife & I are looking to adopt a child either from India/US or a different country. From what I have found out, this seems to be a herculean task. Is this even possible? Has anyone successfully completed this process, or know of the details/steps involved. Any information is appreciated.

I just wanted to share some good news. I had two approved LCs. One with PD EB3 ROW March 05 and the other with ROW EB3 March 06. I had already filed the I-140 for the March 06 but not for the March 05 one. That was because of the way the job requirement was worded in that LC. The attorney was not sure if it would be approved. Anyway since the earlier PD became current in June I decided to take a chance and file I-140 for that earlier PD LC with PP. And what do you know, it got approved today and that allowes me to file for AOS this month. It was a bit of a gamble with money but it worked!!! :cool:

I have a question regarding filling the emp history on G325, I did part time jobs in my university(in the allowed 20 hours) do i need to mention this as well or its just the professional emp part ? The problem is i used to work on and off in my pt jobs which comes out with a lot of periods with breaks in between.

If spillover kicks in (& it should in July) then both China and India will have to move together (exact same cutoff date, because the law says spillover visa's are to be used evenly by those in the same category. USCIS has been doing horizontal spillover, so all EB2's will be equally eligible and have the same cutoff.

If H1 for your spouse is already approved, there should not be any problem provided you carry all necessary documentation. If it is under processing (not yet approved), and you have your H1 approved, your spouse should not have problem for H4.

thank you for confirming. My wife's h1 is approved but once i took the appointment at calgary, the appointment letter mentions that first time COS conversions are strongly urged to go to their home countries as they cannot verify the academic qualifications. I think this is mainly for ppl going on desi consulting companies unlike universities.

Have you tried this option before.
You can use existing visa + new approval notice. Make sure that on arrival the I-94 is stamped until expiration on new approval notice and not the visa expiration date.

Thanks !! My 140 is indeed pending. But I dont have plans to move to EAD now. I am moving to EAD only after my 140 is approved.
